Terms of Service

1. Acceptance of Terms

By accessing or using Questable World ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Questable World is a marketplace platform that connects people who need tasks completed ("Quest Master") with people who can complete them ("Quester"). The Service facilitates the creation, discovery, and completion of real-world tasks ("Quests/Side Quest") and handles payment processing.

3. Eligibility

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

4. Account Registration

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must notify us immediately of any unauthorized access to your account
  • You may not transfer your account to another person

5. User Conduct

You agree not to:

  • Post illegal, harmful, threatening, abusive, or discriminatory content
  • Create quests for illegal activities
  • Harass, abuse, or harm other users
  • Impersonate any person or entity
  • Use the Service for spam or unsolicited communications
  • Attempt to circumvent our payment system
  • Upload malware or malicious code
  • Scrape or collect user data without permission
  • Interfere with the proper functioning of the Service

6. Quest Creation and Completion

6.1 For Quest Master

  • You must provide accurate descriptions of the task to be completed
  • You must fund quests / side quest before they can be accepted by workers
  • You agree to release payment upon satisfactory completion of the quest / side quest
  • Disputes will be handled according to our dispute resolution process

6.2 For Workers

  • You must complete quest / side quests according to the provided specifications
  • You must have the necessary skills and equipment to complete accepted quest / side quests
  • You are an independent contractor, not an employee of Questable World
  • You must complete Stripe Connect onboarding to receive payments

7. Payments and Fees

  • All payments are processed through Stripe
  • A platform fee is deducted from each completed quest payment
  • Payment processing fees (Stripe fees) also apply
  • Fee amounts are displayed before you confirm any transaction
  • Funds are held in escrow until quest completion is confirmed
  • Refunds are handled on a case-by-case basis through our support team

8. Content Ownership

  • You retain ownership of content you create and upload
  • You grant us a license to use, display, and distribute your content on the Service
  • You represent that you have the right to share any content you upload
  • We may remove content that violates these Terms or our policies

9. Content Moderation

We reserve the right to review, remove, or disable access to any content that violates these Terms or is otherwise objectionable. Users can report inappropriate content using the Report feature in the app. Repeated violations may result in account suspension or termination.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE ARE NOT RESPONSIBLE FOR THE ACTIONS OF USERS OR THE QUALITY OF SERVICES PROVIDED BY WORKERS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUESTABLE WORLD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

12. Indemnification

You agree to indemnify and hold harmless Questable World, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Termination

We may terminate or suspend your account at any time for violation of these Terms. You may delete your account at any time. Upon termination, your right to use the Service will immediately cease.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles.

16. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through good faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.
